When the Speaker of the National Assembly Moses Wetang’ula shared a photo of himself visiting ailing Kwanza MP Ferdinand Wanyonyi in India earlier this year, it offered a rare glimpse into a largely unseen reality of Kenyan politics.

Mr Wanyonyi, a third-term legislator and key ally of Mr Wetang’ula, has been undergoing specialised treatment at KIMS Health Care Management Limited for over six months.

His prolonged absence from the country has raised broader questions about representation, accountability and continuity of leadership.

“I was encouraged by the progress he has made and remain optimistic about his recovery,” Mr Wetang’ula said after visiting him in January.

The Speaker had earlier been forced to address speculation about the MP’s condition after rumours of his death spread on social media in December.

“I want to inform the House that Hon Ferdinand Wanyonyi, the Member for Kwanza, is unwell. He was admitted at Nairobi Hospital for about a month, and doctors recommended that he be taken to India. I am saying this to counter malicious rumours in his constituency claiming that he has passed on and that we are withholding information. He has not passed on; he is in a hospital in India and is responding well to treatment,” Mr Wetang’ula told lawmakers on December 4.

According to Ford Kenya Secretary-General Chris Mandu, the MP is now on the path to recovery and undergoing physiotherapy, with hopes that he will return soon.

Yet Mr Wanyonyi’s situation is not unique. Kenya’s political landscape has over the years witnessed several cases of legislators forced to govern from hospital beds or remain absent from their constituencies for extended periods due to illness.

The Constitution and parliamentary standing orders, however, are largely silent on clear procedures for temporary replacement of incapacitated MPs.

Unlike governors or the President whose offices have defined succession frameworks, Members of Parliament retain their seats unless they resign, are recalled or declared incapacitated under strict legal thresholds.

This creates a grey area where informal arrangements often step in.

In Mr Wanyonyi’s case, Mr Wetang’ula reportedly appointed Kiminini MP Kakai Bissau to oversee constituency matters in his absence, an arrangement based more on political goodwill than on codified law.

“Since the MP is still away receiving treatment, Mr Bissau has been in charge. In such situations, the Speaker appoints a friendly MP to ensure that operations in the constituency continue smoothly. As Ford Kenya, we have also been monitoring progress on the ground,” said Mr Mandu Mandu.

These stop-gap measures are typically supported by constituency offices funded through the National Government Constituencies Development Fund (NG-CDF), which has an administrative structure independent of the MP’s physical presence.

Constituency managers, fund managers and ward coordinators often become the backbone of service delivery when an MP is away.

A similar case was seen with Mosop MP Abraham Kirwa, who spent time in the United States following a sickness.

Despite his absence, constituency functions continued through a network of delegated leadership.

“In my case, Mr Julius Melly, the MP for Tinderet, was in charge of the constituency. He is my friend, and I personally proposed to him. He would visit the constituency, monitor developments, and then brief me,” said Mr Kirwa.

He said from his hospital bed, he remained in close contact with key officials handling constituency affairs.

“The CDF manager, constituency manager and funds manager play an integral role. I also had coordinators in all seven wards who provided weekly updates,” he explained.

His experience highlights how modern communication tools, combined with administrative structures, allow MPs to maintain some level of oversight even while physically absent.

There is also the political risk. An absent MP may lose ground to rivals who remain visible at the grassroots, reshaping local power dynamics ahead of future elections.

“If you don’t have a proper system in place, you cannot function effectively. Even your opponents can take advantage of your absence,” Mr Kirwa acknowledged.
